Limited Health Guarantee

This guarantee is hereby agreed to by and between Blackberry Ridge, a Missouri company (herein after referred to as “the breeder”) and the party or parties making the purchase (herein after referred to as “the buyer”) of the animal (herein after referred to as “the puppy”) to which this guarantee refers.  There exists no other guarantee, either written or implied, concerning this purchase.  This guarantee is governed by the laws of the State of Missouri.  Any provision of this guarantee that is not legally enforceable does not invalidate the rest of the guarantee.

The breeder is not responsible for any charges, at any time, incurred by the buyer in relation to the puppy or the puppy’s health, including but not limited to shipping charges, veterinarian charges, shots, worming and/or special diets.

The breeder certifies that this puppy has been examined by a licensed veterinarian prior to shipment and is in good health.   The puppy has had all vaccinations and worming due at age appropriate times.  A shot record will be provided at time of shipment along with AKC and/or CKC registration papers.

The buyer agrees to have the puppy examined within 72 hours of arrival, or immediately, if the puppy shows any signs of poor health.  Failure to do so will make any and all guarantees null and void.  The breeder recommends use of a licensed veterinarian that is knowledgeable about toy breeds.  The breeder also recommends that a stool sample be analyzed at the time of this examination.

The breeder guarantees the puppy for a one-year period from the date of purchase against life-threatening genetic disorders with the following exceptions:

Molera (open fontanel) – it is common for the Chihuahua breed to have this condition (a soft spot on the top of the head).  It is a unique feature of the Chihuahua.

Patella Luxation – This is a condition where ligaments in the paw, feet or legs are too short or too long.  This condition is graded on a scale of 1 to 4, where 1 is only a mild, occasional lameness.  This guarantee does not cover Patella Luxation grades 1 and 2

Trachea – Sometimes known as a “reverse sneezing”, this is a common and non-life-threatening condition in small breeds.

Hernias – of any kind

Testicles - not descending

Should the puppy be diagnosed within six (6) months of arrival with a qualifying congenital defect as determined by a licensed veterinarian, the breeder must be notified within 5 business days of the defect along with the diagnosing veterinarian’s name, address and phone number.  At the breeder’s option, a second medical opinion may be requested at the veterinarian of the breeder’s choosing to confirm the defect and severity thereof.  Should the second opinion coincide with the first, the breeder agrees to pay for the second diagnosis.  If the second opinion determines that the condition does not exist or that the severity of the defect is minimal and not life-threatening, the buyer agrees to pay for the second diagnosis and also agrees that the guarantee does not apply to that defect.

In the event that the defect is confirmed as shown above, and will seriously impact the puppy’s quality of life, or require continuous medical treatment throughout the course of the puppy’s life, the following options will be available:

  1. 1. The buyer may choose to keep the puppy.  The breeder will refund 50% of the purchase price of the puppy upon receipt of proof of spay/neuter and return of AKC/CKC registration papers.
  2. 2. The buyer may choose to return the living puppy and registration papers (signed back to breeder) to the breeder at the buyer’s expense.  The breeder will provide a replacement puppy of equal value, when available.  If shipping is required, the buyer will be responsible for that cost.

The breeder WILL NOT be responsible for any adverse reactions that may occur due to vaccinations administered by the buyer’s veterinarian.

The adult size, color and/or temperament of the puppy are not guaranteed.

This guarantee is not transferable.
